KATHERINE BENESCH practices primarily in the areas of healthcare law and alternative dispute resolution (ADR), with particular emphasis on reimbursement, Medicare and Medicaid, physician group practices, hospital issues (including hospital-physician relationships , credentialing and peer review), academic medical centers, state and federal regulatory matters, False Claims Act, anti-kickback and Stark law issues, managed care, contracting and employment and licensing matters. As a litigator, Ms. Benesch has represented clients in trial and appellate courts, administrative hearings and before state agencies and licensure boards in matters involving physician, hospital, professional, agency and managed care liability, False Claims Act, complex contract, credentialing, commercial, employment and reimbursement disputes, state licensure issues and research misconduct. As an arbitrator and mediator, she has handled many types of cases, including disputes over reimbursement, recoupment (Medicare, Medicaid and private insurance), managed care and complex risk-sharing contracts, billing and collection disputes, mergers and acquisitions, the False Claims Act, hospital disputes, physician practice and employment issues, clinical research trials, and disputes between pharmaceutical manufacturers, suppliers and life sciences companies.
Ms. Benesch has been elected a Fellow of the American Health Lawyers Association and a Fellow of the American Bar Foundation. She is a member of the American, Mercer County, New Jersey and Pennsylvania bar associations, the American Health Lawyers Association (a former vice chair of its Labor & Employment Law Practice Group). She has written numerous articles and lectured throughout the country on healthcare, arbitration, mediation and litigation issues. (See Selected Publications below.) Ms. Benesch has served as a member of the Advisory Board of the BNA Health Law Reporter (now part of Bloomberg), Chair of the CPR Healthcare and Life Sciences Committee, and has served on the American Arbitration Association Healthcare Advisory Council.
Ms. Benesch has served as President of the Princeton Bar Association, Chair of the Health and Hospital Law Section of the New Jersey State Bar Association, Chair of the Princeton Regional Health Commission and Governor of the American Bar Association Health Law Section. Ms. Benesch has served on the Large Complex Case, Commercial, M&A/Joint Venture and National Healthcare Arbitration Panels, as well as the Mediation Panel of the American Arbitration Association (AAA), is a member of the Panel of Arbitrators and Mediators for the International Centre for Dispute Resolution (ICDR) of the AAA, and serves as an arbitrator and mediator for the American Health Law Association.
She has served as an adjunct assistant professor at the University of Pittsburgh School of Medicine and the Robert Wood Johnson Medical School, and on the Technical Review Board of the Princeton Journal of Bioethics. She was named by Nightingale 's Healthcare News as one of twelve Outstanding Hospital Attorneys for 2004, has been elected a Super Lawyer by her peers since 2005, and is listed as one of New Jersey’s Top Rated Lawyers. She has earned an AV Preeminent Peer Review Rating with Martindale Hubbell.
Ms. Benesch was a partner in the Princeton, New Jersey office of Duane Morris, LLP from 2001 through 2010. She returned to her own private practice in 2011. She is admitted to practice in federal and state trial and appellate courts in Pennsylvania, New Jersey, the District of Columbia and the United States Supreme Court, as well as the Northern and Southern Districts of New York. In addition, she has handled matters before state and federal courts in New York, Maryland, Minnesota and other jurisdictions.
Ms. Benesch is a graduate of Duquesne University School of Law, Yale University School of Medicine (M.P.H.) and Wheaton College (Mass.).
